LIMITATIONS OF LIABILITY

All suggestions, advice, or tips found herein do not include guarantees from Creating Perfume Store, and affiliated companies, nor do we accept any liability connected with the use of the information contained within this site. By using this site, you accept ALL terms of the following USER Agreement and understand that your use of the product(s) is at your own risk. This USER Agreement and any disputes arising out of, or related to the site, shall be governed by and construed and enforced in accordance with the laws of the State of California as well as federal law.



USER AGREEMENT

Customers should purchase product(s) from Creating Perfume Store with the clear understanding that all product(s) must be used at the customer’s own discretion and only after referencing provided Safety Data Sheets (SDS) and all other relevant technical information specific to the product(s). Creating Perfume Store shall not be held responsible or legally liable for any damage to property or for any adverse physical effects (including injury or bodily harm) caused by insufficient knowledge or from improper use of a product(s).


The user of the product(s) is solely responsible for acting in compliance with all laws and regulations applying to the use of the product(s), including intellectual property rights of third parties.


As with any manufacturing process, Creating Perfume Store strongly recommends independent lab testing for evaluation purposes prior to full commercial manufacturing.


The information on the Creating Perfume Store website is obtained from current and reliable sources, but makes no representation as to its comprehensiveness or accuracy. Nothing contained herein should be considered as a professional recommendation by Creating Perfume Store as to the quality for any use and should treat all information as “For Educational Use, ONLY.” As the ordinary or otherwise use(s) of this product(s) is outside the control of Creating Perfume Store no representation or warranty, expressed or implied, is made as to the effect(s) of such use(s) (including damage or injury), or the results obtained.


The liability of Creating Perfume Store is limited to the value of the goods and does not include any consequential loss. Creating Perfume Store shall not be liable for any errors or delays in the content, or for any actions taken in reliance thereon.
Please note that all products purchased or provided by Creating Perfume Store are NOT for internal use and should NOT be ingested. Creating Perfume Store shall not be held liable for injury or bodily harm brought on by misuse of a product(s).

Creating Perfume Store reserves the right to update product(s) prices at any time, for any reason. While we strive to maintain accurate and timely price information, we are not ultimately responsible for errors, omissions, or otherwise inaccurate prices on the website. The final amount of money due per order is always determined at checkout, not during shopping cart selection.


For example, customers may put product(s) into the shopping cart during a sale, but may choose to postpone their final checkout until later. The customer is always responsible for the most recent product(s) price, even if their selected product(s) are no longer on sale at checkout time. The customer, likewise, assumes responsibility for any missed discounts, for any reason, due to price changes that may occur between product(s) selection and final checkout, whatever that duration may be.

The information and services available to you on this website may contain errors and the site is subject to periods of interruption. While Creating Perfume Store does its best to maintain the information and services it offers on the website, it cannot be held responsible for any errors, defects, lost profits, and or other consequential damages arising from the use of this website.


Creating Perfume Store provides the information and services available on this website “AS IS,” with no warranties whatsoever. All express warranties and all implied warranties, including warranties of merchantability and suitability for a particular purpose, and non-infringement of proprietary rights are hereby disclaimed to the fullest extent permitted by law. SHIPMENT

All shipments are made Freight On Board from Creating Perfume Store’s shipping point unless otherwise specified. Liability and ownership of goods is transferred from Creating Perfume Store to the Buyer at the time of delivery to the carrier. Buyer assumes all risk of loss in shipping and all liability for loss or damage, whether direct, indirect, consequential or otherwise, due to delays once the product(s) have been delivered to the carrier. Title to product(s) and risk of loss pass to the Buyer upon shipment from the Creating Perfume Store’s warehouse or agent. Buyer agrees to purchase any, and all, insurance it deems necessary to indemnify it against any loss in shipping.



DELIVERY


Creating Perfume Store shall not be liable for damages, general, consequential or otherwise, or for failure to give notice of any delay until it shall have such additional time within which to deliver the product(s) as may be reasonably necessary under the circumstances and shall have the right to apportion its inventory among its customers in such a manner as it considers acceptable.



Creating Perfume Store shall also have the right to deliver the product(s) in installments.



USE OF SITE

Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Creating Perfume Store, or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. TYPOGRAPHICAL ERRORS


In the event that a Creating Perfume Store product(s) is mistakenly listed at an incorrect price, we reserve the right to refuse or cancel any orders placed for product(s) listed at the incorrect price. Creating Perfume Store reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Creating Perfume Store shall issue a credit to your credit card account in the amount of the incorrect price.



PARTICIPATION DISCLAIMER


Creating Perfume Store may not and cannot review all communications and materials posted to or created by users accessing the site and are not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, Creating Perfume Store is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Creating Perfume Store without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.





NOTICE

Creating Perfume Store may deliver notice to you by means of e-mail, a general notice on the site, or by any other reliable method to the address you have provided to Creating Perfume Store.





MISCELLANEOUS

Your use of this site shall be governed in all respects by the laws of the State of California, without regard of choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Creating Perfume Store product(s)) shall be in the provincial or federal courts located in the State of California. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Creating Perfume Store product(s)) must be commenced within one (1) year after the claim or cause of action arises. Creating Perfume Store’s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Creating Perfume Store may assign its rights and duties under this Agreement to any party at any time without notice to you.




DELIVERY TIME: Most U.S. orders shipped via UPS will be delivered 1 to 10 business days from ship date. All international orders, including Hawaii and Alaska, are shipped via UPS and will be delivered within 5 to 7 days from ship date.



DEBIT CARD PURCHASES: We will not be responsible for any bank charges you may incur such as NSF charges because of purchases made on our site. It is always a good idea when making an online purchase with a debit card to check your bank account in a day or two to verify the transaction went through correctly.



SDS: All SDSs are provided by our supplier(s) and manufacturer(s) and not created by Creating Perfume Store. 



MISLABELED PRODUCT(S): We are human. On a rare occasion, a customer may receive an item which is mislabeled. It is the responsibility of the customer to inspect all items upon receipt of a shipment and to look at and smell the product(s) to determine if everything ordered arrived correctly. Please contact us via cs@creatingperfumestore.com if you have discovered an error.  We unfortunately cannot reimburse customers who use a mislabeled product(s) in their formulation. We will only refund the price paid for the erroneous product(s).



OUT OF STOCK ITEMS: Due to the nature of our product(s), from time to time a product shown as in stock on our site will be out of stock when the order is processed. In the event a product(s) purchased is out of stock, Creating Perfume Store has the right to refund the product(s) and ship the rest of the order to prevent delay.



PAYMENT METHODS: All major credit cards are accepted. No checks, no money orders. Our site is completely secure.



QUALITY OF OUR PRODUCT(S): Our product(s) are obtained from ONLY reputable suppliers and manufacturers. Great care is taken when obtaining quality materials for our customers. We provide complete transparency to the best of our ability so that you, the buyer, can make a well-informed decision before making any purchase.


ALL CONSUMER SALES, DOMESTIC or INTERNATIONAL, ARE FINAL.

ORDER CANCELLATIONS: 

Physical products: Consumers can request an order cancellation within 24 hours of order placement. There is a Cancellation fee of 7% of the total invoice

Digital products: Digital products are non-refundable.

Gift Certificate: Consumers can request an order cancellation at any time, unless the Gift Certificate was used. There is a Cancellation fee of 7% of the total invoice.

RETURNS: Due to the nature of our products, we are unable to accept returns.

If a customer demands a refund via a credit card dispute or PayPal dispute, Creating Perfume Store has the right to terminate that customer’s account and all purchasing privileges will be revoked indefinitely.

ORDER FULFILLMENT: We make every effort to fulfill and ship within 1 - 10 business days of order receipt, for US orders, and 7 to 10 Business Day Processing for International orders, excluding weekends and holidays depending on environmental circumstances.

CUSTOMS AND TAXES: Customs regulations and taxes can be different for every country. It is your responsibility to pay for these charges.

ALCOHOL SHIPPING INSURANCE: 
In order to get your PERFUMERS GRAIN ALCOHOL, it is highly advisable to purchase alcohol shipping insurance, that is found in the cart section in the top part. Button should appear in case there is PERFUMERS GRAIN ALCOHOL in the cart.  In case of a damage or loss of the package containing PERFUMERS GRAIN ALCOHOL, there is high possibility that it may not be delivered or refunded. Please, purchase the insurance. 

PERFUMERS ALCOHOL PURCHASES:
We offer products that contain perfuming alcohols and fragrance aroma chemicals derived from tobacco. Legal regulations require that customers be at least 21 years of age to purchase these items. By placing an order for these products, you confirm that you meet the minimum age requirement and are legally permitted to make such purchases in your jurisdiction. We reserve the right to verify your age through appropriate identification measures. Failure to provide valid proof of age may result in the cancellation of your order. It is your responsibility to ensure that any recipient of these products is also of legal age.

SHIPPING INSURANCE will be offered during the checkout process. In the case of a claim, a refund in the form of store credit will be awarded ONLY if insurance is purchased and the carrier has approved the credit. The carrier does not guarantee a refund.

In order to receive store credit, a claim must be made through our customer support (cs@creatingperfumestore.com) within 15 days from the shipping date.

LOST or STOLEN PACKAGE(S) IN TRANSIT:

INSURED LOST or STOLEN PACKAGE(S) in transit that do NOT SHOW ARRIVED at the destination qualify for store credit of the total value** of goods purchased. Once the funds have been applied to our carrier account, a store credit will be applied to your customer account.

All claims made outside of our customer support will not be eligible for a refund.
**The value of the products are determined by the carrier and not by us.

SHOWN AS DELIVERED PACKAGE(S):

STOLEN PACKAGE(S) SHOWING DELIVERED are NOT eligible for store credit and are NOT covered under our carrier's insurance.

DAMAGED PACKAGE(S) that have been insured are eligible for store credit on a case by case basis given that video proof can be supplied. Products that show bottles or bags tampered with, opened, or otherwise not in the original protective sleeves are NOT eligible for store credit despite being insured. ONLY DAMAGED PRODUCTS that meet the above criteria qualify for store credit and at the value** determined by the carrier.

All claims made outside of our customer support will not be eligible for a refund.

Approved store credit can take up to 30 days or longer to be credited to your account.

SAMPLES AND PERFUMER'S ALCOHOL ARE EXEMPTED FROM THE FREE SHIPPING.

INTERNATIONAL FULFILLMENT: It is customer's obligation to understand that customs duties and taxes are their responsibility and that, if necessary, they have the necessary import license or intermediary to process the package upon entering their country. Fulfillment time: 1-10 Business days. Processing for International orders, excluding weekends and holidays depending on environmental circumstances.

FORMULAS: By purchasing fragrance formulas from Creating Perfume Store, you acknowledge that these digital, downloadable PDF products are non-refundable. Once a fragrance formula is purchased, the transaction is considered complete, and no refunds will be issued.

CONSULTATIONS:

Creating Perfume Store offers three types of consultations:

  • Perfuming Consultation: For formulating fragrances for fine perfumes, soaps, candles, and more.
  • Business Consultation: For legalities and business development.
  • Manufacturing Consultation: For manufacturing and packaging beauty products, including fine fragrances and cosmetics.

Booking and Cancellation Policy

Booking:

  • Consultations can be booked up to 24 hours prior to the scheduled consultation time.

Cancellation:

  • Cancellations must be made at least 24 hours prior to the scheduled consultation time. If advanced cancellations are made, a 10% re-booking fee will be applied.
  • Cancellations made within 24 hours will incur a 25% re-booking fee.
  • No refunds will be given for NO SHOW cancellations.

NO SHOW Cancellations:

  • A NO SHOW cancellation occurs when the customer does not inform the company of their inability to attend and fails to show up within 15 minutes of the consultation start time.

Technical Issues

Company's Technical Issues:

  • In the event of technical issues on the company's end, the customer will be informed and given the opportunity to book a new appointment at the next available slot.

Customer's Technical Issues:

  • No new tickets or rescheduled appointments will be issued in the case of technical issues on the customer's end.

General Terms

Consultation Types:

  • Perfuming consultations cover formulating fragrances for various applications including fine perfumes, soaps, and candles.
  • Business consultations focus on legalities and business development strategies.
  • Manufacturing consultations provide guidance on manufacturing and packaging beauty products like fine fragrances and cosmetics.

Consultation Duration:

  • Each consultation is scheduled for a 60 minutes as indicated at the time of booking.

By booking a consultation with Creating Perfume Store, you agree to these terms and conditions. Please ensure you understand and accept them before proceeding with your booking.

Summer Sale – 20% Off: Terms & Conditions

  1. Discount

    • A 20% discount applies to eligible products during the Summer Sale period.

    • The discount will be applied at checkout.

  2. Eligibility

    • The offer is valid for all original perfume notes, fragrance concentrates, bases, aroma chemicals, and perfume formulas listed as part of the Summer Sale.

    • The discount cannot be combined with any other promotions, sales, discounts, coupons, or offers.

  3. Sale Period

    • The promotion runs until September 21, 2025, or while supplies last, whichever comes first.

  4. Stock Availability

    • All products are offered on a first-come, first-served basis.

    • Once a product is sold out, it will not be restocked under this promotion.
